1. Acceptance of Terms

By accessing and using https://www.mauihawaiiphotographer.com (the "Site") and/or engaging Flocus Studio ("we," "us," "our") for photography or videography services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our Site or services.

2. Services Description

Flocus Studio provides professional:

  • Real estate photography

  • Real estate videography

  • Aerial/drone photography (when applicable)

  • Virtual tours

  • Related media services for residential and commercial properties in Hawaii

3. Booking and Scheduling

3.1 Booking Process:

  • All bookings require a signed service agreement and deposit

  • Scheduling is subject to availability

  • We reserve the right to refuse service at our discretion

3.2 Cancellation and Rescheduling:

  • Cancellations with 48+ hours notice: Full deposit refund

  • Cancellations with 24-48 hours notice: 50% deposit refund

  • Cancellations with less than 24 hours notice: No refund

  • Rescheduling: Must be requested at least 24 hours in advance

  • No-shows: Full session fee charged

3.3 Property Requirements:

  • Property must be "photo-ready" at scheduled time

  • Client is responsible for obtaining necessary access permissions

  • Homeowner/agent must be present or provide access instructions

  • Utilities (power, water) must be operational

4. Pricing and Payment

4.1 Pricing:

  • Prices listed on website are subject to change

  • Custom quotes provided upon request

  • Travel fees may apply for locations outside standard service areas

4.2 Payment Terms:

  • Deposit: 50% required to secure booking

  • Balance: Due upon delivery of preview images or within 7 days of shoot

  • Late payments: Subject to 1.5% monthly interest

  • Accepted methods: Credit card, bank transfer, check

4.3 Additional Costs:

Client responsible for:

  • MLS listing fees (if applicable)

  • Additional licensing fees for extended use

  • Rush processing fees (if requested)

  • Travel expenses for remote locations

5. Intellectual Property Rights

5.1 Copyright Ownership:

  • Flocus Studio retains full copyright to all images and videos created

  • All work is protected by U.S. and international copyright laws

  • Copyright is not transferred with payment

5.2 Client License:

Upon full payment, client receives:

  • Non-exclusive, perpetual license for real estate marketing purposes

  • License includes: MLS listings, real estate websites, social media, print materials

  • License does NOT include: Commercial use, resale, stock photography, or transfer to third parties without written permission

5.3 Portfolio Usage:

We reserve the right to:

  • Use completed work in our portfolio, website, and marketing materials

  • Share images on social media platforms

  • Submit work to photography awards and publications

Note: We respect client privacy and can provide anonymity upon request.

6. Delivery and Turnaround

6.1 Standard Delivery:

  • Photography: 24-48 hours for standard shoots

  • Videography: 3-5 business days

  • Delivery via secure online gallery or cloud transfer

6.2 Rush Service:

Available for additional fee (50% surcharge):

  • Same-day delivery for photography

  • 24-hour delivery for videography

6.3 Revisions:

  • Minor editing adjustments: Up to 5 included revisions

  • Major re-edits: Additional fees may apply

  • Revision requests must be made within 7 days of delivery

7. Property and Client Responsibilities

7.1 Client Must:

  • Ensure property is clean, staged, and ready for photography

  • Provide accurate property information

  • Obtain necessary permissions for photography

  • Secure pets or notify us of animals on premises

  • Disclose any safety concerns or restrictions

7.2 Weather and Conditions:

  • Outdoor shoots subject to weather conditions

  • We reserve right to reschedule due to poor weather

  • "Golden hour" shoots are scheduled based on sunset/sunrise times

8. Limitations and Disclaimers

8.1 Service Limitations:

We are not responsible for:

  • Concealing property flaws or defects

  • Poor lighting conditions due to property features

  • Image quality affected by weather or environmental factors

  • Issues arising from client's failure to prepare property

8.2 Liability Limit:

Our maximum liability for any claim shall not exceed the total amount paid for services. We are not liable for:

  • Indirect, incidental, or consequential damages

  • Loss of business opportunities

  • Client's failure to sell or rent property

8.3 Drone Operations:

  • All drone operations comply with FAA regulations

  • Flights subject to weather and airspace restrictions

  • Additional permits may be required for certain locations

9. Model Release and Property Release

9.1 People in Images:

  • Client is responsible for obtaining model releases for any people photographed

  • We can provide standard model release forms

  • Failure to obtain releases limits usage rights

9.2 Property Releases:

  • Client warrants they have authority to permit photography of property

  • For rental properties: Written permission from owner required

  • Commercial properties may require additional releases

10. Website Use Terms

10.1 Acceptable Use:

You agree not to:

  • Copy, reproduce, or distribute site content without permission

  • Use site for unlawful purposes

  • Attempt to hack or interfere with site functionality

  • Use automated systems to access the site

10.2 User Content:

By submitting testimonials, reviews, or comments:

  • You grant us permission to use them in marketing

  • Content must be truthful and not defamatory

  • We reserve right to remove inappropriate content

11. Third-Party Services

We may use:

  • Squarespace: Website hosting and CMS

  • Google Services: Analytics, advertising, email

  • Payment processors: Stripe, PayPal, etc.

  • Delivery platforms: Dropbox, Pixieset, etc.

  • Editing software: Adobe Creative Cloud

12. Indemnification

Client agrees to indemnify and hold harmless Flocus Studio, its employees, and contractors from any claims, damages, or expenses arising from:

  • Client's breach of these terms

  • Unauthorized use of images

  • Property damage or personal injury during shoot (except due to our negligence)

  • Copyright infringement claims from third parties

13. Force Majeure

We are not liable for delays or failures due to circumstances beyond our control including:

  • Natural disasters

  • Severe weather

  • Equipment failure

  • Illness or accident

  • Government restrictions

  • Utility outages

14. Governing Law

These Terms shall be governed by the laws of the State of Hawaii. Any disputes shall be resolved in the courts of Maui County, Hawaii.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of our Site or services constitutes acceptance of updated terms.

16. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

17. Entire Agreement

These Terms, along with any signed service agreement, constitute the entire agreement between parties and supersede all prior agreements.
